Calling Upon The Services Of A Custody Evaluator

In contested cases, the court is likely to appoint a mental health professional to serve as a custody evaluator. He or she will conduct a full custody evaluation in order to present a report to the court that will outline what he or she believes to be in the best interests of the children. Additional experts may also need to be involved, due to the nature of these high-conflict custody cases.

The custody evaluator will look at the following types of factors, among others, when compiling his or her report:

  • The child's emotional attachment to each parent and interest in stability and continuity of the custodial arrangement
  • The distance of the proposed relocation
  • The motivation behind the proposed move
  • The ages of the children
  • The children's relationship with both parents
  • The current custody arrangement and parenting plan
  • What time-sharing schedule would be in the best interest of the child after the move
  • The wishes of the children if appropriate
