H. Mathew Moore is a veteran lawyer who has practiced before state and federal courts in California, at both the trial and appellate court level, for over 30 years. Mr. Moore is widely recognized as a skilled, aggressive and effective litigator and appellate advocate. Mr. Moore heads the firm's complex litigation and appellate litigation practice, serving the firm's clients in a broad range of high stakes and complex commercial lawsuits. In his 30 plus years of practice, Mr. Moore has successfully represented both plaintiffs and defendants in jury trials, bench trials, in commercial arbitration proceedings, and on appeal.

Mr. Moore's litigation practice includes: contract disputes, partnership and corporate shareholder disputes (including corporate dissolution), commercial torts, including unfair competition, interference with contract and economic advantage, trade secret misappropriation, trademark and copyright infringement, and "faithless fiduciary" litigation concerning corporate officers and directors. Clients (both businesses and individuals) are often faced with "emergency" litigation issues, particularly when served with a request for a temporary restraining order or needing to request such prompt judicial intervention at the outset of litigation. Mr. Moore has extensive and successful experience and expertise in defending against and affirmatively seeking such relief—the results of which can often mean the difference between complete success and ultimate failure of the clients' business or livelihood.

In addition, a number of the firm's high net worth family law clients are frequently faced with complex community property characterization, division and valuation issues that cannot be voluntarily resolved without significant litigation and possible trial. Such family law litigation includes characterization, division and valuation of partnership and other equity interests held by professional service providers (including doctors and lawyers), hedge fund managers, venture capitalists and real estate developers; employee stock options; deferred compensation; as well as pre-marriage assets and businesses and inherited wealth, together with the fruits thereof. In addition, Mr. Moore has substantial experience in litigating contract issues that often are presented in marital dissolution proceedings including: the enforceability of pre-nuptial agreements and post-nuptial agreements, and the enforceability of marital settlement agreements. Also, in light of California's comprehensive disclosure and fiduciary obligations imposed upon spouses in marital dissolution actions, Mr. Moore not only assists in ensuring that our clients fulfill their obligations, but has litigated extensively (and successfully both at the trial court level and on appeal) the enforcement of the opposing party's disclosure and fiduciary obligations (including obtaining substantial sanctions as part of enforcement). Also, from time to time the opposing party in marital dissolution litigation will seek to use the litigation to seek very sensitive, private information from a party or third party. Mr. Moore has successfully thwarted undue intrusions into the private information of non-parties as well as exceptionally personal information of our marital dissolution clients.

In such cases, Mr. Moore's extensive and successful lead trial counsel experience is invaluable in preparing and presenting complex matters to the courts and juries to ensure that our clients' positions are relentlessly and successfully advanced.

Prior to joining Flicker, Kerin, Kruger & Bissada LLP in 2001, Mr. Moore was a commercial litigator and director with the San Francisco law firm of Howard, Rice, Nemerovski, Canady, Falk & Rabkin, where he specialized in complex commercial litigation.

Professional Involvement

Mr. Moore is a member of the San Mateo County Bar Association as well as the California State Bar – Intellectual Property Law, Litigation and Family Law Sections.

Other Distinctions

Mr. Moore has, for the past 20 years, had the AV rating (the highest rating given) and has been named in the annual listings of Martindale-Hubbell Bar Register of Preeminent Lawyers; a position attained through the recognition of colleagues for distinguished work in the field.

Mr. Moore served as a judicial clerk to the Honorable Donald P. Lay, Judge, U.S. Court of Appeals, Eighth Circuit.
